Starting A Food Business/Temporary Food Stall/Health Business

The Food Act 1984 requires all businesses that prepares, handles, packs or sells any food/drink must be registered with their local council.

Registering a new food business

Follow the steps below to register your food business:

Step 1 - Submit a Floor Plan

Provide a scaled floor plan of the proposed food premises to Council Environmental Health Department for assessment showing:

Step 2 - Determine the Classification

Please review the Classification List at the Food Smart Victoria website to determine which class applies to your business. The food safety requirements are linked to the class of food premises.

Please note: Class 4 food businesses do not need to register as a food premises but you do need to notify Council. To notify, complete the Notification form (PDF format - 119KB). An acknowledgement of your notification will be sent.

Step 3 - Apply for Registration

Complete the Application to Register a Food Premises form(PDF format - 156 KB) and return to Council with the applicable fee. Please contact Council's Environmental Health Department on 03 5832 9731 to find out the applicable fee for the class of premises.

As part of the application process Class 1 and 2 businesses need to have a Food Safety Program in place and ensure the person nominated for the role of Food Safety Supervisor has completed the relevant training.

Step 4 - Arrange for a Final Inspection

An Environmental Health Officer will complete an inspection of the food premises once works are completed.

Step 5 - Approval

Council will then issue a Certificate of Registration. Under the Food Act it is an offence to operate a food business without being registered.

Temporary Food Premises Requirements

If you are intending to sell food to the public from a temporary food premises in Greater Shepparton, you must either:
1. Notify the council,
2. Submit a statement of trade, or
3. Register with the council depending on which type of food you are planning to sell.
The following information outlines the requirements for temporary food premises and is separated into commercial and not for profit/community group requirements.
It is expected that all temporary and mobile food premises are setup in compliance with Food Standards Code and that food sold to the public is safe and suitable.

Commercial Temporary and Mobile Premises

Under the new state-wide registration system for temporary and mobile food premises, the food business must register with the ‘principal council' and submit a ‘Statement of trade' (SOT) to each other council area that you will trade in.
Your principal council is the council in which the premise is based, equipment is stored or garaged, or the first trade occurs in for interstate traders. Once registered with the principal council, a statement of trade must be submitted to any other council that you trade in.

Contact Council's Environmental Health team, who will assist you with becoming registered and advise you which class you will fall into depending on the risk level of food sold.

Not for Profit and Community Groups

Not for profit and community groups are also required to operate under the new state-wide registration/notification system. This includes any group that is fundraising through the sale of food, it does not include food provided free of charge.
There are different levels of registration depending on the risk/type of food a Not for Profit/Community Group is selling. Below is a table that outlines class 2, 3 or 4 activities.

 High risk foods which need correct temperature control at all times to keep them safe, such as:

  • salads, sandwiches, smoothies and fresh juice made on site. 
  • casseroles, curries etc which are cooked and held hot, or cooked, cooled and reheated.

 Unpackaged low risk foods or pre-packaged high risk foods or cook and serve foods such as:

  • biscuits, nuts, cereals, jams etc if removed from packaging.
  • pre-packaged high risk food including cakes with cream fillings, or meals (eg lasagne) or pies/sausage rolls.
  • barbeques including hamburgers, other meats or eggs cooked and served immediately.

 Low risk activities including such as:

  • shops and stalls with packaged cakes (excluding cream cakes and raw egg), bottled jams or honey 
  • simple sausage sizzles at stalls, where the sausages are cooked and served immediately. This means sausages, sauce, onions and bread. (This does not include hamburgers or other high risk foods). 
  • sale of uncut fruit and vegetables at farmers markets or by greengrocers (whether retail or wholesale) 
  • wine tasting 
  • tea and coffee

Notification

If you fall into a Class 4 premises then you are required to complete and submit Notification by a Community Group Temporary Food Premises form (N4)

If you are selling any food that falls into a class 2 or 3 food premises, then registration is required.
You will need to complete and submit Application to Register Temporary Food Premises - Community Group form (R5 or R6)
On this form you can include up to 12 known event/s and date/s of trading. Or alternatively, if you do not know all upcoming event/s you can complete a Statement of Trade for Temporary Food Premises (SOT1) form at least 5 days prior to the next event/s. If your community group is conducting a one off event and you only want registration for that event, then that can be indicated on the form also.

Any applicable payment information is detailed on the application form and should be paid on lodgement.

Your application will be assessed and on approval you will receive a Class 2 or Class 3 food registration.

Food Complaint

If you have found a foreign material (e.g. insect, hair, stone) in food you have purchased, or suspect you may have fallen ill from something you have eaten, contact the Council's Environmental Health Department on 5832 9731 to report this matter.

Important: Keep all suspect foods and packaging in the fridge for further investigation. Please remember to keep all high risk foods (perishable foods) cold (below 5 degrees).
